Terms of Service
Version 1.0 · Effective 27 August 2026 · WakaConnect Ltd
These Terms of Service (“Terms”) are an agreement between you and WakaConnect Ltd (“WakaConnect”, “we”, “us”) and govern your use of the WakaBid mobile application and the wakabid.com website (together, the “Service”). By creating an account, downloading the app or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are and what WakaBid is
WakaConnect Ltd is a company registered in Nigeria (RC 9809331) with its registered office at 18B Presidential Road, Ogui, Enugu State, Nigeria.
WakaBid is a technology marketplace that connects passengers who want a ride with drivers who are willing to provide one. We provide the platform, the bidding mechanism, the verification and the payment records. We are not a transport company, we do not own or operate vehicles, and we do not employ drivers. Each trip is a separate agreement between the passenger and the driver.
2. Eligibility
- You must be at least 18 years old to use the Service.
- Drivers must hold a valid Nigerian driver’s licence and provide accurate details of the vehicle being used, including its registration or plate number, as requested during verification.
- You must provide information that is accurate, current and your own. Accounts may not be sold, shared or transferred.
- We may decline, suspend or end access for anyone who does not meet these requirements.
3. Your account, codes and PIN
- You sign in with your phone number or email address. For your protection, a one-time code is sent only to the phone number or email address already bound to your account.
- In day-to-day use the app opens with your PIN or your phone’s fingerprint or face unlock. Those unlock methods work offline and cost nothing. A verification code is used only when you sign in on a new device, when you have forgotten your PIN, when you add a payout account for the first time, or for a large withdrawal. A trusted device does not ask again for about 180 days.
- Keep your PIN, code and device secure. You are responsible for activity that happens through your account. Tell us immediately if you believe someone else has access to it.
4. How the marketplace works
- A passenger requests a trip by entering the pickup point and destination. Nearby verified drivers who are available see the request and may submit an offer with their own fare.
- The passenger compares the offers — price, rating and arrival time — and chooses. No algorithm sets the fare; the drivers who bid do. The passenger decides which offer to accept.
- You may not submit an offer on your own request. Drivers may also use WakaBid as passengers; when they do, they cannot bid on their own trip.
- A driver who submits an offer is making a genuine offer to perform that trip for that price. Repeatedly submitting offers that are not honoured, or accepting a trip and not completing it, may lead to restrictions on the account.
5. Fares, payments, wallet and withdrawals
- The fare for a trip is the amount in the offer the passenger accepts. WakaConnect charges a commission on completed trips; the applicable rate is shown in the app, and drivers see their net earnings before and after each trip.
- Trip payment is made at the time the request is placed. Funds are held for the trip and released to the driver’s earnings balance when the trip is completed.
- Drivers may withdraw their earnings to a bank account. There is no withdrawal fee. We may require a verification code for the first payout to a new account or for a large withdrawal, as described in section 3.
- Promotional credit, referral credit and other non-cash balances are not withdrawable as cash and may be subject to conditions we publish in the app.
- We never ask for your card PIN, bank password, or your account code over the phone, WhatsApp, SMS or email. Anyone who does is not us. Report it to us immediately.
- Where a trip is cancelled, not started, disputed or affected by a payment failure, we may hold, reverse or adjust the amounts involved, and we will tell you why.
6. Driver commitments
- Keep your licence, vehicle documents and contact details current, and keep the app up to date so that verification and safety features work.
- A clear profile photograph is required for drivers, so passengers can recognise who is arriving. Photographs are optional for passengers.
- Provide the trip you accepted, at the price you offered, to the destination requested, unless safety or a genuine emergency prevents it.
- Drive safely and lawfully, do not use your phone while driving, do not drive under the influence of alcohol or drugs, and do not carry more passengers than your vehicle and licence permit.
- Do not ask passengers to pay outside the app, and do not solicit fares, tips or personal contact details on the platform.
7. Passenger commitments
- Be ready at the pickup point you entered, and be reachable in the app.
- Treat the driver and the vehicle with respect, and do not damage the vehicle or leave the trip without paying the fare you agreed.
- Do not ask the driver to break the law, take extra passengers, or carry unlawful, dangerous or prohibited items.
- Cancel clearly and promptly if your plans change, so the driver’s time is not wasted.
8. Prohibited conduct
You must not:
- impersonate anyone else, or use another person’s account or documents;
- create fake accounts, fake trips or fake ratings;
- harass, threaten, discriminate against or endanger anyone, including through the in-app communication channels;
- use the Service for anything unlawful, including carrying prohibited goods or evading the law;
- copy, scrape, reverse engineer, resell or interfere with the Service or its security;
- attempt to obtain codes, passwords or bank details from any other user, or from anyone claiming to act for us.
9. Safety
The app includes a safety button (SOS) for emergencies, and you should always contact the emergency services first where there is immediate danger. Trip details are recorded so that incidents can be investigated. Report any safety concern to us through the app or at wakaconnect26@gmail.com, and we will review it. We cooperate with law enforcement and with regulators where the law requires it.
10. Cancellations and no-shows
A passenger may cancel a request. Where a driver has already accepted a trip or is already travelling to the pickup point, a cancellation charge may apply and will be shown in the app before you confirm the cancellation. Repeated cancellations or no-shows by either side may lead to restrictions on the account.
11. Ratings and account restrictions
Passengers and drivers rate each other after trips. Ratings, reports and verification results are used to keep the marketplace safe. We may warn, restrict, suspend or close an account where there is a breach of these Terms, a safety concern, a fraud concern, or repeated poor conduct. Where we suspend an account we will tell you the reason, and you may contact us to ask for a review.
12. Our role and limits of responsibility
WakaBid is a technology platform. The contract for a trip is between the passenger and the driver. We do not provide the transport, and we are not responsible for the conduct of passengers or drivers, for the condition of a vehicle, or for anything that happens during a trip, except where Nigerian law makes us responsible. We do not guarantee that the Service will be uninterrupted or error-free, that a request will always receive an offer, or that a particular driver or passenger will use the Service.
Where you are a driver, you are an independent provider. You are responsible for your own taxes, pension, insurance and compliance with any licence or permit that applies to your vehicle and your work.
13. Limitation of liability
To the extent permitted by Nigerian law, WakaConnect Ltd is not liable for indirect or consequential losses, loss of profit, loss of goodwill, or loss of data arising from your use of the Service. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, or for fraud.
14. Intellectual property
The WakaBid name, logo, app, website, and all content we create are owned by WakaConnect Ltd or licensed to us. You may use the app and the website for their intended purpose. You may not copy, modify, distribute or use our brand or content commercially without our written permission, except for content you own or share yourself.
15. Privacy
Our Privacy Policy explains what personal data we collect, why, and the rights you have. It forms part of these Terms.
16. Ending your use of the Service
You may stop using the Service and ask us to close your account at any time. We may suspend or end your access where you breach these Terms, where we are required to by law, or where continuing to provide the Service would put other users at risk. Where your account is closed, sections that by their nature should survive (including payments owed, limitation of liability, intellectual property and dispute resolution) will continue to apply.
17. Changes to these Terms
We may update these Terms as the Service develops. When we make significant changes we will notify you in the app, by email or on the website, and update the effective date above. If you continue to use the Service after the changes take effect, you accept the updated Terms. If you do not agree, you may stop using the Service and close your account.
18. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Before starting formal proceedings, please contact us at wakaconnect26@gmail.com so we can try to resolve the matter directly. If that is not possible, the courts of Enugu State, Nigeria have jurisdiction over any dispute arising from these Terms or the Service.
